User Agreement (Terms of Service)

1. Acceptance of Terms

By accessing or using Kirkify AI ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you may not access the Service.

2. Use of Service

Kirkify AI is a tool designed for satirical and parody purposes only. You agree to use the Service only for lawful purposes and in accordance with these Terms.

Prohibited Uses

You specifically agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any private individual or entity for malicious purposes.
• Mislead others into believing that the AI-generated content is real or authentic media depicting actual events or persons.
• Remove, obscure, or alter any watermarks or labels applied by the Service.
• Infringe upon the intellectual property or privacy rights of others.

3. Content Disclaimer

AI Satire Only: The content generated by Kirkify AI is artificial and created for entertainment and satirical purposes. It does not represent real individuals or events.

Labeling Requirement: You agree to maintain any watermarks or disclosures applied to the generated images. When sharing content generated by Kirkify AI on social media or other platforms, you must clearly indicate that the content is AI-generated and/or a parody.

4. User Content

You retain all rights to the images you upload to the Service. By uploading content, you grant Kirkify AI a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of providing the Service to you.

5. Payments and Credits

Kirkify AI is a paid service. Registration does not include free credits. You must purchase a credit package before processing images.

• Purchases: All purchases are final and non-refundable, except as required by applicable law. Payments are processed securely via our third-party provider, Creem.io.
• Expiration: Credits purchased have specific validity periods (e.g., 30, 90, or 180 days) as stated at the time of purchase. Expired credits cannot be reinstated or refunded.
• Usage: Credits are consumed for each successful image generation.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Limitation of Liability

In no event shall Kirkify AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
